NRI property: separate acquisition, tax and remittance decisions

Research revision · 20 October 2026. Newly researched replacement text, not a recovered original. Sources and remaining limitations appear below.

Buying a property, selling it and remitting the proceeds abroad are separate decisions. The earlier page compresses them into one service promise; that promise and its CA arrangements remain unverified.

RBI's published FAQ, updated 6 April 2023, distinguishes NRI/OCI purchase from inheritance: its purchase route excludes agricultural land, farmhouses and plantations, while inheritance has separate conditions. It specifies banking channels and permitted non-resident accounts for payment, rather than travellers' cheques or foreign-currency notes. RBI property FAQ, Part II

RBI's Master Direction, displayed as updated 1 September 2022, distinguishes the remittance-of-assets facility from repatriation linked to qualifying foreign-exchange-funded acquisition. The latter requires lawful acquisition and qualifying funding, and limits residential-property repatriation to two such properties. It is therefore misleading to describe every property sale as one automatic USD 1 million NRO route. RBI Master Direction, Part II, paragraphs 8.1–8.2

For an actual sale, assemble an acquisition history: purchase/inheritance date, prior residency, original payment source, loan repayments, sale consideration and intended remittance. The authorised dealer needs to identify the applicable route against current rules. These dated RBI publications are a source map, not a complete audit of amendments through 2026.

Tax is a separate workstream. Have the adviser identify the applicable Act, payment/credit dates, residency treatment, withholding basis and any certificate before fixing the seller's net receipt. This draft intentionally does not carry forward a universal TDS rate or the assertion that Forms 15CA/15CB are required for every remittance. The 2026 tax transition and transaction-specific form requirements still need verification.

No current Hobo coverage across nineteen countries, filing service, certificate outcome or full-proceeds remittance is promised.
